Terms of Service

These terms govern the use of the Pleco platform by businesses ("the Brand", "you"). By creating an account you accept them. The service is for business use only, by adults authorized to bind their company.
1. The service
Pleco lets you create and distribute digital loyalty cards on Apple Wallet and Google Wallet, manage points, and send notifications to customers who installed your card. Some features depend on third-party integrations (for example Shopify) that you connect yourself.
2. Accounts and security
You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for all activity under your account. Notify us promptly of any unauthorized access.
3. Subscription and billing
- The service is provided as a monthly subscription billed through Stripe.
- Payment is due in advance; paid features require an active subscription.
- Started periods are non-refundable, except where the law provides otherwise.
- Prices may change with at least 30 days notice, applying from the next period.
- Unpaid invoices may lead to suspension after notice.
4. Acceptable use
You agree not to:
- send communications without a legal basis to contact the recipients;
- distribute unlawful, misleading, defamatory or infringing content;
- attempt to bypass technical limits, quotas or platform security;
- resell the service without prior written agreement.
You warrant that your customers have agreed to receive your loyalty communications and that your campaigns comply with applicable regulations (including GDPR and direct marketing rules). You indemnify us against third-party claims arising from your content or campaigns.
5. Third-party platform dependency
The service relies on platforms we do not control: Apple Wallet, Apple's push notification service, Google Wallet, and Shopify where connected. We do not guarantee their availability or the stability of their rules, and we are not liable for interruptions, restrictions or changes they decide. We will make reasonable efforts to adapt.
6. Data (processing annex)
For your customers' data, you are the controller and Pleco acts as a processor within the meaning of the GDPR: we process that data only to provide the service and per your documented instructions, using the subprocessors listed in our Privacy Policy. We provide confidentiality, security, reasonable assistance with data subject requests, breach notification, and deletion or return of the data at the end of the contract (export available for 30 days).
7. Intellectual property
The platform, its code and its brand remain our exclusive property. Your logos, content and trademarks remain yours; you grant us a limited license to display and distribute them as part of the service (cards, notifications).
8. Availability and support
The service is provided "as is", with reasonable efforts on availability and fixes. No service level (SLA) is guaranteed unless separately agreed in writing. Maintenance may cause occasional interruptions.
9. Liability
To the maximum extent permitted by law, our total aggregate liability, all causes combined, is capped at the amounts you paid us in the twelve (12) months preceding the triggering event. We are not liable for indirect damages: loss of revenue, customers, data or goodwill. Nothing in these terms excludes liability that cannot be limited by law.
10. Term and termination
- You may terminate at any time from your dashboard or by email; termination takes effect at the end of the paid period.
- We may terminate with 30 days notice, or immediately for serious breach or persistent non-payment.
- After termination, your data is exportable for 30 days, then deleted per the Privacy Policy.
11. Miscellaneous
We may modify these terms with reasonable notice; continued use constitutes acceptance. Neither party is liable for failure caused by force majeure. If a clause is held invalid, the rest remains enforceable.
12. Governing law
These terms are governed by French law. Any dispute falls under the competent courts of Paris, subject to applicable mandatory rules.
